Conflicto de competencia suscitado entre el Juzgado Segundo Promiscuo Municipal de Natgaima, Tolima, el cual considera que la entidad demandada es de orden nacional y por lo tanto remitió el expediente al Tribunal Superior del Distrito Judicial de Ibagué, el cual no avocó el conocimiento de la acción atendiendo a las directrices expuestas en el auto 124 de 2009.
La Sala encuentra que la entidad accionada es de orden nacional por lo tanto es competente el Tribunal Superior del Distrito Judicial para dar tramite a la decisión de primera instancia y proferir una decisión de fondo.
